Frequently Asked Questions

A controller or processor based outside the EU requires an EU representative pursuant to Art. 27 GDPR if it does not have an establishment within the EU, but offers goods or services to persons in the EU or monitors the behaviour of individuals in the EU (in particular tracking or profiling).

The GDPR provides for exemptions from the obligation to designate in the case of only occasional processing of less sensitive personal data or if the data processing is carried out by a public body. Unless an exception applies, an EU representative is mandatory by law under Article 27 GDPR.
The appointment of the representative needs to be in writing. Furthermore, the representative has to be identifiable. This means they must be mentioned in the privacy policy or in the information provided to data subjects before each collection of data, see Article 13 GDPR. It is also mandatory that supervisory authorities can easily find out who your representative is, for example by publishing it on your website. Having a representative will not affect your own responsibility or liability under the GDPR.

The representative shall be established in one of the Member States where the data subjects, whose personal data are processed in relation to the offering of goods or services to them, or whose behaviour is monitored, are.

Note there is no need to appoint a representative in all EU Member States where data subjects are based, whose data you are processing. 

If a company or organisation fails to appoint a representative, fines may be imposed. The fine is 2% of the global turnover or €10.000.000, whichever is higher.
