Nach britischem Recht, genauer gesagt nach Artikel 27 der UK-GDPR, müssen Unternehmen, die nicht in Großbritannien ansässig sind, einen Vertreter in Großbritannien benennen, wenn sie Personen in Großbritannien Waren oder Dienstleistungen anbieten oder deren Verhalten überwachen. Die Anforderung der UK-GDPR spiegelt die Anforderung der EU-DS-GVO wider. Die Anforderungen, die eine Verpflichtung zur Bestellung eines Vertreters begründen, sind recht niedrig. Der britische Vertreter kann eine Einzelperson, ein Unternehmen oder eine Organisation sein. Die Bestellung des Vertreters muss in schriftlicher Form erfolgen. Außerdem muss der Vertreter identifizierbar sein. Das heißt, er muss in der Datenschutzerklärung oder in den Informationen, die den betroffenen Personen vor jeder Datenerhebung zur Verfügung gestellt werden, genannt werden, siehe Artikel 13 UK-GDPR. Es ist auch zwingend erforderlich, dass die Aufsichtsbehörden (z. B. das ICO) leicht herausfinden können, wer Ihr Vertreter ist, z. B. durch Veröffentlichung auf Ihrer Website. Einen Vertreter zu haben, hat keinen Einfluss auf Ihre eigene Verantwortung oder Haftung nach der UK-GDPR. Behörden oder Organisationen, die nur gelegentlich oder mit geringem Risiko Daten verarbeiten, benötigen keinen Vertreter gemäß Artikel 27 (2) der UK-GDPR

The UK Representative must be based in the UK. As a result, as of January 1st, 2021, EU-based companies and organisations need a UK representative and UK-based companies and organisations need to appoint an EU representative. Companies or organisations which are neither located in the UK nor the EU need to appoint a UK and an EU representative in order to comply with the UK-GDPR and the EU-GDPR.
If a company or organisation fails to appoint a representative, fines may be imposed. The fine is 2% of the global turnover or £8.7 million, whichever is higher.
