Complete E-Evidence Solution by Rickert.Law and EviGate

Following several years of preparation, Rickert Rechtsanwaltsgesellschaft mbH and nGENn GmbH have launched a joint venture: EviGate GmbH (currently in formation). EviGate GmbH provides a legal-tech platform designed to simplify how companies navigate the challenges of the EU E-Evidence Package.

This package comprises the E-Evidence Regulation (EU 2023/1543), an accompanying Directive (EU 2023/1544), and national implementing laws. Under these rules, companies must directly respond to preservation and production orders issued by authorities in other EU member states. Previously, businesses only had to handle requests from domestic authorities.

A critical hurdle for affected businesses is that in emergency cases, incoming orders must not only be legally vetted within 8 hours, but requested subscriber, traffic, or content data must also be dispatched – complete with a qualified electronic signature – to the requesting authority via a specialized IT infrastructure.

nGENn is responsible for the technical development of the EviGate platform, which connects directly via API to the public IT system and significantly streamlines case handling. Key features include automated deadline tracking with email and SMS alerts (including escalation rules), qualified electronic signatures or seals and PKI infrastructure, and audit-proof logging of all processes.

While most companies maintain 24/7 technical support for outages, round-the-clock legal support for e-Evidence compliance is rarely in place.
